Terms of Service

Effective date: April 25 2025

Welcome to Quizbuds (the “App”, “Site”, and together the “Service”). By downloading, installing, or using Quizbuds, you (“you”, “User”) agree to follow these Terms of Service (“Terms”). If you don’t agree, don’t use the Service—simple as that.

1. Eligibility

   You must be at least 13 years old (or the age of digital consent in your country) and legally able to form a contract. If you’re under 18, you need a parent or guardian’s permission.

2. Changes to These Terms

   We can update these Terms at any time. We’ll post the new version at https://quizbuds.app/terms and update the “Effective date” above. Continuing to use Quizbuds after the change means you accept the new Terms.

3. Accounts & Security

   You may need an account (email, social login, or Apple/Google Game Center) to save progress, rankings, or in-app purchases. You’re responsible for safeguarding your login credentials. Tell us immediately if you suspect unauthorised use.

4. Intellectual Property

   Quizbuds, including all trademarks, logos, code, graphics, and quiz content we create, belongs to Quizbuds Limited (“Company”, “we”, “us”). Your use is a licence—not a transfer of ownership.

5. Limited Licence

   We grant you a personal, non-exclusive, revocable, non-transferable licence to:

   • Install the App on devices you own or control, and
   • Access our Site at https://quizbuds.app

   for your own non-commercial entertainment.

   You may not:

   • modify, copy, or create derivative works from the materials;
   • make commercial or public use of the Service (e.g., reselling questions or leader-board data);
   • reverse-engineer, decompile, or attempt to extract source code;
   • remove proprietary notices;
   • “mirror” the Service on another server or device.

   Violation of any point voids this licence and may get your account terminated—see § Termination.

6. User-Generated Content (“UGC”)

   If Quizbuds lets you write questions, post images, comments, or other content:

   • Your Rights: You keep ownership of your UGC.
   • Our Rights: You grant us a worldwide, royalty-free licence to host, store, display, reproduce, and distribute your UGC solely to operate or promote the Service.
   • Your Promises: Your UGC must be legal, not infringe anyone’s rights, and not be hateful, obscene, or spammy. We may remove UGC at any time.

7. Virtual Items & Purchases

   The App may offer paid features, coins, lives, subscriptions, or other virtual items (“Virtual Items”) processed by Apple App Store, Google Play, or Stripe. Purchases are final and non-transferable. Prices include all taxes where required. Your statutory consumer rights in New Zealand remain unaffected.

8. Third-Party Links

   Quizbuds may link to external sites. We don’t control or endorse them and use is at your own risk.

9. Disclaimer of Warranties

   Quizbuds is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied—including merchantability, fitness for a particular purpose, and non-infringement. We don’t guarantee the Service will be error-free, uninterrupted, or that quiz answers are always correct (hey, trivia evolves).

10. Limitation of Liability

    To the maximum extent permitted by law, Quizbuds Limited will not be liable for indirect, incidental, special, consequential, or punitive damages (lost profits, data, goodwill, etc.) arising from your use—or inability to use—the Service, even if we’ve been advised of the possibility. Where such limits are disallowed, our liability is capped at the greater of (a) the amount you paid us in the past 12 months or (b) NZD 50.

11. Indemnity

    You’ll defend and indemnify us against any claims, damages, or expenses arising from your breach of these Terms or misuse of Quizbuds.

12. Revisions & Errata

    Materials on Quizbuds may contain technical, typographical, or photographic errors. We don’t promise they’re accurate, complete, or current and we’re not obliged to update them.

13. Termination

    We may suspend or terminate your account or access to the Service at any time, for any reason (for example, breach of these Terms, fraud, or inactivity). Upon termination, all licences end and you must delete the App. Sections 4, 9–14, 16, and 17 survive termination.

14. Governing Law & Dispute Resolution

    These Terms are governed by the laws of New Zealand, excluding its conflict-of-laws rules.

    • Informal Resolution: Email [email protected] within 30 days of the issue.
    • Arbitration: If unresolved, disputes will be finally settled by confidential arbitration in Auckland under the Arbitration Act 1996. You and we waive the right to a jury trial, unless banned by law.
    • EU/UK Consumers: You may also bring claims in your home courts.

15. Severability

    If any part of these Terms is unenforceable, the rest remains in effect.

16. Entire Agreement

    These Terms, plus our Privacy Policy, are the whole agreement between you and us and supersede all prior understandings.
